Terms and Conditions

1 Ordering, payment and title


1.1 A non-refundable, non-transferable 25% booking fee is paid by the Client to the Photographer, to secure the date of the wedding. The booking will not be confirmed until this payment is received.


1.2 Within 6 weeks of the date of the wedding the Photographer shall deliver USB and upload proofs online for the Client to choose quantities and sizes of reproduction to print.


1.3 The Photographer shall deliver the prints (if added onto package) as ordered within 28 days of the Client having made their print choices.

1.4 The Client shall pay the Photographer the final balance of all money due under this agreement at least two weeks before the day of the assignment or at any point prior this. The payment of all reprints and enlargements is due on the date of ordering.

1.5 Travel expenses of 45p per mile (subject to change at fuel costs at the date of event) are payable for weddings outside of the Bristol and North Somerset areas. All other parking expenses and road tolls incurred must also be paid by the client 2 weeks prior to the event.

1.6 Such title as has been agreed to pass, to the intellectual property in the images produced in the course of the Assignment shall not pass to the Client until payment of the contract price has been paid.

1.7 A £50 archive retrieval fee is payable if package prints are not ordered within 6 months of the wedding. Prints will not be delivered until this has been received.

2 Photographer’s obligations

2.1 This contract is personal to the Photographer and may not be assigned unless illness or injury prevents the photographer from fulfilling the contract.

3 Photographer’s status

3.1 The Photographer is an independent contractor. The Photographer acknowledges that this agreement does not constitute an employment contract between the Client and the Photographer.

4 Cancellation of agreement

4.1 If the Client cancels this agreement, or fails in some other way to facilitate the performance of this contract the 25% booking fee will not be returned. If cancelled within the 2 weeks prior to the wedding no monies will be returned.

5 Insurance
The Photographer undertakes to obtain insurance against liability for professional negligence and against circumstances which prevent her from fulfilling this contract.

6 Intellectual property


6.2 In any event, the Photographer undertakes that she will not sell any image produced as part of this assignment to any person except the Client or without permission of the client.

7 Force majeure

7.1 Neither party shall be liable for any breach of their obligations resulting from causes beyond their reasonable control.

7.2 Causes deemed to be beyond reasonable control shall include:

7.2.1 Death or serious injury or illness of a close family member;
7.2.2 Severe Injury or illness to the Photographer personally rendering her incapable of fulfilling the contract.
7.2.3 War, natural disaster including floods and fire or other circumstances beyond control of either party.
7.2.4 Mechanical failure of any equipment used by the photographer.

7.3 Each of the parties agrees to give notice immediately to the other upon becoming aware of an event of force majeure such notice to contain details of the circumstances giving rise to it.

8 Notices
Any notice to be served on either of the parties by the other shall be sent by or pre paid recorded delivery and shall be deemed to have been received by the addressee within 72 hours of posting.

9 Dispute Resolution
In the event of a dispute arising out of or in connection with this Contract and which has not been resolved following discussions and negotiations between a person or persons appointed or authorised by the Customer and the Writers then they undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.

10 Jurisdiction
This agreement shall be construed according to the laws of England.
